When does the Party Wall etc. Act 1996 apply?
It can apply to work on a shared wall or structure, certain excavations near neighbouring buildings and construction of a new wall on or near the boundary.
How much notice must a building owner give?
The statutory notice period is commonly one or two months depending on the work. Serve notice early enough to allow for questions or a dispute.
Can the same surveyor act for both owners?
Yes. If both owners agree, one Agreed Surveyor can act impartially for them under the Act.
Does a neighbour have the right to stop lawful work?
The Act does not normally allow a neighbour to prevent lawful work, but the correct procedure must be followed and protective terms may be included in an award.
